Public hearing before the Planning Commission of Fairfax County, Virginia, to be held at the Fairfax County Government Center, 12000 Government Center Parkway, Fairfax, Virginia 22035, on a proposed amendment to the Code of the County of Fairfax, Virginia (County Code) Chapter 118 (Chesapeake Bay Preservation Ordinance).

Pursuant to the authority and mandates of the Chesapeake Bay Preservation Act, Article 2.5 (§ 62.1-44.15:67 et seq.) of Chapter 3.1 of Title 62.1 of the Virginia Code, the and Chesapeake Bay Preservation Area Designation and Management Regulations, Chapter 830 of Title 9 of the Virginia Administrative Code (Regulations), the amendment proposes to incorporate criteria regarding the preservation of mature trees or planting of trees, coastal resilience and adaptation to sea-level rise and climate change as required by the changes to sections 9VAC25-830-130, 140 and 155 of the Regulations. The proposed ordinance adds provisions requiring assessment of impacts to sea level rise and storm surge on projects within the Resource Protection Area (RPA) as part of the Water Quality Impact Assessment, specify limitations on the placement of fill in the RPA, allow adaptation measures in the RPA subject to certain criteria, and provides the Director may exempt living shorelines from certain performance criteria. The proposed amendment also adds provision for the preservation of mature trees and specifies trees must be protected and preserved during development where feasible and consistent with the proposed development. The proposed amendment also includes clarification of appeals of decisions made by the Board of Supervisors, and other minor changes and editorial corrections.
