ORDER OF PUBLICATION

SJV 1 ARLINGTON LLC (“Plaintiff”), by counsel, and an Affidavit in Support of Request for Order of Publication having been filed by the Plaintiff, and

IT APPEARING TO THE COURT, that the object of this suit is to declare and quiet title to a triangular shaped parcel of unimproved real property consisting of approximately 750 square feet of land +/- (the “LAND”) being a part of certain real property occupied by Plaintiff commonly known as 2000 North Glebe Road, Arlington, Virginia (RPC #07006344) (the “Glebe Road Property”) and being adjacent to the eastern boundary line of certain real property owned by Defendant SUNRISE OF ARLINGTON PROPCO, LLC (“Sunrise”) commonly known as 4725 20th Street North, Arlington, Virginia (RPC # 07006150); and

IT APPEARING TO THE COURT, that the LAND is located in Arlington County, Virginia, and is a portion of a larger parcel of land sometimes known as “CLARK HILL” that was originally subdivided into thirty-one (31) lots by REBECCA E. CLARK, the owner thereof, in 1935; and

IT APPEARING TO THE COURT, that REBECCA E. CLARK conveyed a portion of the Glebe Road Property by Deed dated December 1, 1943, recorded in the land records maintained in the Clerk’s Office of the Circuit Court of Arlington County (the “Land Records”) at Deed Book 628, Page 193; and

IT APPEARING TO THE COURT, that REBECCA E. CLARK departed this earth on April 3, 1962, and pursuant to her Will, dated November 7, 1958 (the “1958 Will”), and recorded in Will Book 45, Page 293, among the probate records of Arlington County, Virginia, left any and all interest she had in and to any of the land then located in Clark Hill to her son, GENERAL MARK WAYNE CLARK, in trust for his benefit and for the benefit of her grandson and General Clark’s nephew, WAYNE CARR CLARK; and

IT APPEARING TO THE COURT that pursuant to the 1958 Will, GENERAL MARK WAYNE CLARK, as Trustee, was authorized to sell and convey any and all real property located in CLARK HILL owned by REBECCA E. CLARK at the time of her death and distribute the proceeds thereof to the beneficiaries of the trust; and

IT APPEARING TO THE COURT, that the remaining property located in CLARK HILL owned by REBECCA E. CLARK at the time of her death consisting of nine (9) lots was sold and conveyed by her son, GENERAL MARK WAYNE CLARK, as Trustee, by Deed dated July 9, 1962, and a recorded in the Land Records at Deed Book 1480, Page 044; and

IT APPEARING TO THE COURT, that GENERAL MARK WAYNE CLARK departed this earth on or about April 17, 1984 and WAYNE CARR CLARK departed this earth on or about September 9, 1967; and

IT APPEARING TO THE COURT, that it is appropriate that this Court enter an Order for service upon the PARTIES UNKNOWN named as Defendants pursuant to Virginia Code Section 8.01-316, by Order of Publication in a newspaper of general circulation published in and approved by the Circuit Court for Arlington County, Virginia;

NOW, THEREFORE, it is hereby:

ORDERED that any and all persons or entities having or claiming any legal, equitable, possessory, or other interest in or to the LAND ( as described above) and any and all PARTIES UNKNOWN being any and all of the HEIRS AT LAW, NEXT OF KIN, DEVISEES, OR SUCCESSORS IN TITLE OF (i) REBECCA E. CLARK, deceased; (ii) MARK WAYNE CLARK, deceased; or WAYNE CARR CLARK, deceased, must appear on or before the 17th day of January, 2025, and make known to this Court by filing in the Clerk’s Office of the Circuit Court of Arlington County, Virginia located at 1425 N. COURTHOUSE ROAD, ARLINGTON, VA 22201, an appropriate answer, defense, or other response they may have to the Complaint filed herein and setting forth the nature of their claim or interest in the LAND and

any objection they may have to the granting of the relief sought by the Plaintiff, otherwise an Order of Relief may be entered in favor of the Plaintiff.
