This lawsuit is an action asking the Court to quiet title to real property located in Fairfax County known as 5936 North Kings Highway, Alexandria, Virginia 22303 (“Property”), and upon such determination of title to partition the Property, or, in the alternative, to order sale of the Property and make division and distribution of the proceeds of such sale to the owners in accordance with their respective interests, and

IT APPEARING THAT determination of proper title to the Property includes or may include determination of the proper ownership of partial interests in the Property which passed under the last will and testament (“Will”) of Betty Marie Ayres Embrey, Deceased (“Decedent”), which Will has been admitted to probate and is under administration in this Court, to two named beneficiaries of the Property in the Will who predeceased the Decedent, namely Martin Darrell Jones and Robert Grant Jones, either to their respective surviving descendants, if any, pursuant to Virginia Code Section 64.2-418, or, if none, to the beneficiaries of the residue of the Estate under the terms of the Will pursuant to Virginia Code Section 64.2-418, and

IT FURTHER APPEARING THAT Martin Darrell Jones, a named beneficiary of an interest in the Property under Decedent’s Will, predeceased Decedent and that there are or may be one or more persons, whose names are unknown, who are or may be surviving descendants of Martin Darrell Jones (“Parties Unknown”) who may claim to have an interest in the Property through Decedent’s Estate pursuant to Virginia Code Section 64.2-418; and therefore, it is hereby,

ORDERED THAT the all such Parties Unknown, if any, claiming identification as a surviving descendant of Martin Darrell Jones appear on or before June 18, 2025 in the Clerk’s Office of the Circuit Court of Fairfax County, Virginia and do what may be necessary to protect his or her interest in this cause. Written Answer may be filed with the Clerk’s Office in lieu of Court appearance and should be received by June 18, 2025.
