ORDER OF PUBLICATION

This matter came before the Court on Plaintiff’s Affidavit in Support of Service by Publication, pursuant to Virginia Code § 20-104 and § 8.01-316. It appearing from the face of that Affidavit that

1. Plaintiff Melinda Harris is over the age of eighteen and resides at 8210 Crestwood Heights Drive, McLean, Virginia 22102, in Fairfax County, Virginia.

2. Plaintiff filed an Amended Complaint for Divorce against Defendant Justin Demetre Walker (“Defendant”) on September 18, 2024, in the Circuit Court of Fairfax County, Virginia.

3. A copy of the Amended Complaint was sent to Defendant via both email and first-class U.S. mail on January 21, 2025, to Defendant’s last known address (1 Chome-17-2 Apt 301, Tokyo, Japan 176-0023) and to his email address (jsanposhi@gmail.com). Those mailings were for informational purposes only and were not accompanied by a court-issued Summons; Defendant has refused to sign or otherwise acknowledge the Amended Complaint.

4. Upon information and belief, Defendant resides in Tokyo, Japan, and is neither a resident of Virginia nor available for personal service within this Commonwealth.

5. Under Virginia Code § 20-104 and § 8.01-316, service by publication is authorized when a Defendant is a nonresident or cannot be found within the State after due diligence.

Accordingly, it is hereby ORDERED:

1. Plaintiff is authorized to serve Defendant by publication. Plaintiff shall cause the Summons and Amended Complaint to be published once each week for four (4) consecutive weeks in the Washington Times

2. Plaintiff shall mail, by first-class mail, a copy of this Order of Publication and a copy of the Summons and Amended Complaint to Defendant at his last known address:

3. If required by local practice, Plaintiff shall also post a copy of this Order of Publication and the Summons and Amended Complaint on the bulletin board of the Fairfax County Circuit Court Courthouse.

4. No depositions, hearings, or final orders shall be held or entered until at least ten (10) days have elapsed following the completion of the four (4) weekly publications and the mailing described above.

5. Upon completion of the fourth weekly publication, the newspaper shall furnish Plaintiff with an affidavit or certificate evidencing the dates of insertion. Plaintiff shall file that affidavit or certificate with the Clerk of this Court prior to any further proceeding.

6. The Clerk is directed to forward a copy of this Order of Publication, together with the Summons and Amended Complaint, to the designated newspaper immediately upon entry of this Order, so that publication may commence as soon as practicable.

7. The Court retains jurisdiction over this matter for such subsequent proceedings as required once Defendant has been deemed served by publication in accordance with Virginia law.
