NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS
FOR TIERED PROJECTS AND PROGRAMS

On or after September 26, 2025, Montgomery County will submit a request to the U.S. Department of Housing and Urban Development (HUD) District of Columbia Field Office Community Planning and Development Office (CPD) for the release of Community Development Block Grant (CDBG) funds under Title I of the Housing and Community Development Act of 1974, as amended and HOME Investment Partnership Program (HOME) funds under Title II of the Cranston-Gonzalez National Affordable Housing Act of 1990 to undertake the following projects:
Tier 1 Broad Review Project Title: Housing Acquisition and Preservation.
Purpose: Funds will be used for affordable housing activities.
Location: Within the county boundaries. Specific addresses will be assessed in the site-specific reviews.
Project Description: Eligible activities include loans to assist in the purchase of existing properties for use as housing affordable to low- and moderate-income residents and funds for housing rehabilitation to enable low- and moderate-income owners of single-family homes and owners of multi-family properties occupied by low- and moderate-income tenants to eliminate code violations and make other necessary improvements, including accessibility, energy conservation, and neighborhood revitalization. Assistance may also be provided for group home acquisition. Tier 2 site-specific reviews will be completed for those laws and authorities not addressed in the tier 1 broad review for each address under this program when addresses become known.

Tier 2 Site Specific Review: The site-specific reviews will cover the following laws and authorities not addressed in the Tier 1 broad review: Flood Insurance, Contamination and Toxic Substances, Floodplain Management, Historic Preservation, Noise Abatement and Control.
Mitigation Measures/Conditions/Permits (if any):
1. Flood Insurance
This will be a site-specific review with the FEMA Floodplain Mapping program. If the property location is in the 100-year Floodplain, a current Flood Insurance policy covering at least the amount of the grant will be verified in perpetuity.
2. Contamination and Toxic Substances
This will be a site-specific review with the EPA Mapping program, and visual inspection through the HUD contamination checklist, with mitigation as required depending on the level of contamination.
3. Floodplain Management
This will be a site-specific review using the HUD five-step avoidance process (55.12(a)) to determine if the property under review is a candidate for this tiered review. When a property in the 100-year floodplain is assisted it must carry flood insurance as stipulated in #1 above. The county reserves the right to address floodplain locations outside of this tiered review as deemed appropriate.
4. Historic Preservation
This will be a site-specific consultation with the Maryland Historic Trust to determine any required mitigation for historic impacts to a National Register listed historic property or potentially eligible historic property is present.
5. Noise Abatement and Control
This site-specific review will only be required when all candidate property windows, doors and wall system will be addressed in the rehabilitation. Procedures listed in the HUD Noise Guidebook will be followed to assure adequate noise attenuation is met or the property will be addressed outside of this tiered review in its own individual review.

Tier 1 Broad Review Project/Program Title: Focused Neighborhood Assistance.
Purpose: Funds will be used as Focused Neighborhood Assistance (FNA) to provide financial and technical assistance to select affordable neighborhoods to improve the quality of life, safety and welfare of residents.
Location: Within the Montgomery County boundaries of Wedgewood and other areas (Specific addresses will be assessed in the site-specific reviews).
Project/Program Description: The Focused Neighborhood Assistance (FNA) program includes financial and technical assistance, design, and planning for select affordable neighborhoods, to improve the quality of life, safety, and welfare of residents. For example, construction services for the Wedgewood Drainage and Site Improvement Project are approximately 80% complete and are expected to be finished in FY24. This project will benefit Eighty-one households and correct grading and drainage issues throughout its common areas. In addition, landscaping will be installed in parking islands to deter the placement of bulk trash in these areas. Facility planning is now underway for potentially five additional FNA projects. The Neighborhood Revitalization staff will be meeting with HOA and/or Condominium Association boards and residents to determine the scope of projects for these communities. Design and construction activities will follow. Tier 2 site-specific reviews will be completed for those laws and authorities not addressed in the Tier 1 broad review for each address under this program when addresses become known.

Tier 1 Broad Review Project/Program Title: Group Home Rehabilitation).
Purpose: Funds will be used to assist nonprofit providers in rehabilitating group homes
Location: Within the Montgomery County boundaries. Specific addresses will be assessed in the site specific reviews.
Project/Program Description: Funds will be used to assist nonprofit providers in rehabilitating group homes occupied by lower-income, special needs persons to eliminate code violations and make other necessary improvements, including accessibility and energy conservation improvements. Tier 2 site specific reviews will be completed for those laws and authorities not addressed in the tier 1 broad review for each address under this program when addresses become known.

Tier 1 Broad Review Project/Program Title: Single Family Rehabilitation (City of Rockville)
Purpose: Funds will be used by the City of Rockville will assist single-family homeowners with home repairs.
Location: Single-Family properties within the City of Rockville. Specific addresses will be identified in the Tier 2 review step.
Project/Program Description: Projects may include replacement of lead-based or non-lead-based paint, roofing, venting and/or gutter materials, windows, entry doors, unsafe porches, concrete on privately-owned lot causing unsafe conditions, disabled or dangerous heating, plumbing, or electrical systems. Tier 2 site specific reviews will be completed for those laws and authorities not addressed in the tier 1 broad review for each address under this program when addresses become known.

Purpose: Neighborhood improvements ranging from sidewalks, roadway, and stormwater treatment infrastructure, to facade and streetscape improvements in Ward 5 of the City of Takoma Park within CDBG eligible areas
Location: Within the City of Takoma Park boundaries. Specific addresses will be assessed in the site-specific reviews.
Project/Program Description: Project will include improvements ranging from sidewalks, roadway, and stormwater treatment infrastructure, to facade and streetscape improvements within CDBG-eligible areas. Project/Program Description: Projects may include or the construction, acquisition, and / or rehabilitation of housing (both multi- and single-family units). DHCA may work with the private sector, non-profits and / or the Montgomery County Housing Opportunities Commission (HOC) in implementing this program. Tier 2 site specific reviews will be completed for those laws and authorities not addressed in the tier 1 broad review for each address under this program when addresses become known.

The activities proposed above are categorically excluded under HUD regulations at 24 CFR Part 58 from National Environmental Policy Act (NEPA) requirements per 24 CFR, Part 58.35(a)(6). An Environmental Review Record (ERR) that documents the environmental determinations for these projects is on file at Montgomery County Department of Housing and Community Affairs, 1401 Rockville Pike, 4th Floor, Rockville, Maryland 20852 and may be examined or copied weekdays between the hours of 8:30 a.m. and 5:00 p.m., Monday through Friday. or at https://www.hudexchange.info/programs/environmental-review/environmental-review-records/.
PUBLIC COMMENTS
Any individual, group or agency may submit written comments on the ERR to the Montgomery County Department of Housing and Community Affairs. All comments received by September 25, 2025, midnight, will be considered by Montgomery County prior to authorizing a submission of a request for release of funds.
ENVIRONMENTAL CERTIFICATION
Montgomery County certifies to HUD that Scott Bruton, Certifying Officer, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows Montgomery County to use the program funds.
OBJECTIONS TO RELEASE OF FUNDS
HUD will accept objections to its release of funds and the Montgomery County certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) The certification was not executed by the Certifying Officer of Montgomery County; (b) The county has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) The grant recipient or other participants in the development process have committed funds, incurred costs, or undertaken activities not authorized by 24 CER Part 58 before approval of a release of funds by HUD; (d) Another federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, 58.76) and shall be addressed, Attention: Mr. Michael D. Rose, Director, Community Planning and Development Division. Potential objectors should contact HUD at 202-275-6266 to verify the actual last day of the objection period.
