ORDER
Pending before the Court is Plaintiffs’ Motion for Alternative Service of Process, filed June 3, 2026. The Court previously granted Plaintiffs’ request for service by publication, filed May 18, 2026. The Court’s May 21, 2026 Order errantly required Plaintiffs to include more of the case record than just the Order granting service by publication. This Order amends the May 21, 2026
Order as it pertains to service by publication.
ACCORDINGLY, it is this 15th day of June 2026, hereby
ORDERED that Plaintiffs’ Motion for Alternative Service of Process, filed June 3, 2026,
is GRANTED; it is further
ORDEREDthat service on any unknown person who may claim an ownership interest or lien upon any of these addresses: 401, 405-409 Butternut Street NW, 6900, 6902, 6904, 6906, 6908, 6910, 6912, 6914, and 6918 4th Street NW, Washington, DC 20012 (Square 3276, Lots 23,39, 40, 41, 43, 44, 46, 51, 52, 53, 54 (the “Properties”) shall be made by publication of this Order; it is further
ORDERED that any unknown person who may claim an ownership interest or lien upon the Properties shall cause his or her appearance to be entered herein on or before the ninetieth (90) day, exclusive of Saturdays, Sundays, and legal holidays, occurring after the date of first publication of this Order; otherwise, this cause will be proceeded with as in the cause of default; and it is further
ORDERED that Plaintiffs maintain an online repository of all documents docketed in the case, hosted on Dropbox during the pendency of this matter, and made available at
https://www.dropbox.com/scl/fo/wa3dillbqxwmqvnfrqq2o/AFUXnnDAgPnGaFWWWoE_P1g?r lkey=754u5oqt00ol8k76vcsb9yhmt&dl=0.; and it is further
ORDERED that Plaintiffs effect valid service of process by publication in accordance with all the provisions to the extent applicable in D.C. Super. Ct. Civ. R. 4-I and D.C. Code § 13-341, to include a copy of this Order, and a notice describing the Dropbox repository, twice a month over the course of three (3) months in two (2) newspapers, such as the Daily Washington Law Reporter, the Washington Post, or Washington Times; it is further;
ORDERED that Plaintiffs effect valid service of process by posting a copy of the entire record of the case and a notice describing the Dropbox repository detailed above outside both the Butternut Street and 4th Street Properties; and it is further
ORDERED that the Remote Initial Scheduling Conference scheduled for July 24, 2026, is CONTINUED to Friday, September 25, 2026, at 11:00 a.m., in Virtual Courtroom 320; it is further
ORDERED that any person in this action must cause their appearance to be entered herein during or before the Remote Initial Scheduling Conference on Friday, September 25, 2026, at 11:00 a.m., which will be held in Virtual Courtroom 320. Any interested party’s failure to enter an appearance at or before the Remote Initial Scheduling Conference may cause the above-captioned matter to proceed as in case of default; it is further
ORDERED that Plaintiffs file proof of service in accord with the alternative methods described above, on or before Friday, September 18, 2026.
