NOTICE OF PUBLIC HEARING

PLANNING COMMISSION

NOTICE is hereby given pursuant to the provisions of the Code of Virginia and the Code of the Town of Vienna that a public hearing will be held by the Planning Commission in the Vienna Town Hall, 127 Center Street, South, Vienna, Virginia, on Tuesday, November 10, 2026, beginning at 7:30 PM on the following:

Amendments to Chapter 17, Tree Conservation Ordinance, are proposed in Sections 17-2001, 17-2002, 17-2003, 17-2004, 17-2005, 17-2006, 17-3001, 17-6001, 18-237, 18-304, 18-305, 18-306, 18-335, 18-353, 18-531, 18-814, 18-818, 18-840, 18-841, 18-903, and 18-905. The amendments would implement Virginia HB 549 (2026) by requiring that the minimum tree canopy for development and redevelopment be projected to be met within 10 years, rather than 20 years.

Amendments to Chapter 18 are proposed in Sections 18-237, 18-304, 18-305, 18-306, 18-335, 18-353, 18-531, 18-814, 18-818, 18-840, 18-841, 18-903, and 18-905. The amendments would:

• establish use standards, design standards, and a review process for wireless facilities, including:

o permitting wireless facilities in all zoning districts, subject to standards, but not on single-unit residential parcels without a public, institutional, or community use;

o allowing building-mounted facilities up to 12 feet above the permitted building height, and towers up to 150 feet with a setback of at least 125 percent of tower height;

o providing administrative review for facilities 50 feet or less in height, co-locations, and installations on existing structures, with a conditional use permit required for new structures over 50 feet;

o permitting temporary wireless facilities with Town Manager approval; and

o adding wireless facility definitions;

• authorize the Windover Heights Board of Review to review landscaping projects, replace the Conservation and Sustainability Commission member of the Board with a resident of the Windover Heights Historic District, allow the Board of Architectural Review and the Planning Commission to appoint their own members to the Board, and revise the Board’s meeting and appeal procedures;

• allow up to eight outdoor dining seats without additional off-street parking, and revise the definitions of outdoor dining and restaurant;

• permit specialized instruction by right, rather than as a conditional use, in the AW, AE, AC, M, CS, NM, T, GS, and CP zones and as an accessory use in the PR zone; establish off-street parking standards for specialized instruction; and revise the definitions of specialized instruction and personal services.

At said public hearing, any and all interested persons will be given an opportunity to express their views and to speak in favor of the proposal or in opposition thereto. Persons desiring to speak are requested to notify staff prior to the night of the public hearing. Please contact the Department of Planning & Zoning at (703) 255-6341 or DPZ@viennava.gov for more information.
