Default having been made in the terms of a certain Deed of Trust dated 10/26/2005, in the original principal amount of $785,000.00 and recorded in the Clerk's Office of the Circuit Court of the Fairfax county, Virginia on 10/31/2005 , as Instrument No. 2005044870.009, in Book 17908, Page 0378, the undersigned Substitute Trustees will sell at public auction on 01/28/2025 at 12:45 PM, Circuit Court of Fairfax County, Main Entrance, 4110 Chain Bridge Road, Fairfax, VA 22030, the property designated as:
Beginning at a nail set on the Southerly right-of-way line of Clifton Road, Route 645, said point being a corner to property in the name of W. Kenneth Hampton; thence with said Clifton Road the following four courses and distances S. 84 degrees 14` 39", East 100.00 feet to an iron pipe set; N. 85 degrees 08` 05", East 62.04 feet to an iron pipe set; N. 65 degrees 48` 52", East 69.01 feet to an iron pipe set and N. 480 degrees 30` 52", East 68.95 feet to an iron pipe set at the corner of property in the name of Henry J. Rolfs; thence with Rolfs the following four courses and distances; S. 46 degrees 01` 58", East 154.23 feet to an iron pipe found; S. 49 degrees 50` 19", East 167.01 feet to an iron pipe found; S. 26 degrees 48` 50", East 202.00 feet to an iron pipe set; and S. 45 degrees 10` 20", West 298.15 feet to an iron pipe set in the boundary of Wade L. Hampton; thence with Wade Hampton the following two courses and distances; N. 35 degrees 29` 17", West 146.32 feet to an iron pipe found and N. 83 degrees 53` 39", West 349.22 feet to an iron pipe found at the corner of the aforesaid W. Kenneth Hampton parcel; thence with said W. Kenneth Hampton, N. 05 degrees 42` 21", East 381.70 feet to the beginning, containing 5.3560 acres, more or less.
TERMS: CASH. A deposit of $78,500.00 or 10% of the sale price, whichever is lower, will be required of the successful bidder at time of sale. Prior to the sale, interested bidders will be required to register with and must present a bid deposit which may be held during the sale by the trustee. The bid deposit must be certified funds and/or cash, but no more than $9,900.00 of cash will be accepted. The successful bidder's deposit will be retained at the sale and applied to the sale price. If held by the trustee, all other bid deposits will be returned to the unsuccessful bidders. Settlement is to be made within 15 days. The successful bidder will be responsible for obtaining possession of the property, and for all costs and fees related to recording the Trustee's Deed, including the grantors tax. The successful bidder will be required to execute a Memorandum of Trustee's Sale, available for review upon request before the sale, outlining additional terms of sale and settlement. A Trustee's Deed will be prepared by Trustee's attorney at high bidder's expense.
