Under and by virtue of the power of a Declaration of Easements and Covenants (“Declaration”) applicable to Montpelier Village Condominium (“Lienholder”), and recorded among the Land Records of Prince George’s County, Maryland in Liber 5308, Folio 372, of which Francis Ries (“Lienor”) is obligated to pay their duly levied Condominium assessments to Montpelier Village Condominium (“Lienholder”), and said Declaration secured by a Statement of Condominium Lien, recorded on November 7, 2022, among the Land Records of Prince George’s County, Maryland in Book 48284, Folio 215, and default having occurred under the terms thereof, and at the request of the party secured thereby, the undersigned Substitute Trustee will offer for sale at public auction in front of the entrance to the Duval Wing of the Prince George`s County Courthouse Complex, 14735 Main Street, Upper Marlboro, Maryland, 20772 on:

The property is believed to be improved by a residential condominium dwelling. The property address is 10301 45 th Place, Unit 101, Beltsville, MD 20705.
Said property is in fee simple and is sold in an “as is condition” and subject to all covenants, conditions, liens, restrictions, easements, rights-of-way as may affect same, if any, and with no warranty of any kind.
Terms of Sale: A deposit of $1,000.00 will be required of the purchaser, other than the Holder of the Note or its assigns, at the time of sale, such deposit to be in cash or certified check, or other form acceptable to the Substitute Trustee, in his sole discretion. Balance of the purchase price is to be paid in cash within ten (10) days of the final ratification of sale by the Circuit Court for Prince George’s County. If payment of the balance does not take place within ten (10) days of ratification, the deposit may be forfeited and property may be resold at the risk and expense of the defaulting purchaser. The defaulting purchaser shall not be entitled to any surplus proceeds or profits resulting from any resale of the property. Interest to be paid on unpaid purchase money at the rate pursuant to the deed of trust note from date of sale to date funds are received in the office of the Substitute Trustee in the event the property is purchased by someone rather than the note holder. In the event settlement is delayed for any reason, including, but not limited to, exceptions to the sale, bankruptcy filings by interested parties, or court administration of the foreclosure, there shall be no abatement of interest. Taxes, ground rent, water, condominium fees and/or homeowner association dues, all public charges, assessments payable on an annual basis, including sanitary and/or metropolitan district charges and front foot benefit charges, if applicable, to be adjusted for the current year to date of sale and assumed thereafter by the purchaser. Cost of all documentary stamps, transfer taxes and settlement expenses shall be borne by the purchaser. Purchaser shall be responsible for obtaining physical possession of the property. Purchaser assumes the risk of loss or damage to the property from the date of sale forward. If the Substitute Trustee is unable to convey good and marketable title, the purchaser’s sole remedy in law or equity shall be limited to the refund of the deposit. Upon refund of the deposit, this sale shall be void and of no effect, and the purchaser shall have no further claims against the Substitute Trustee.
