Default having been made in the terms of a certain Deed of Trust dated 11/04/2004, in the original principal amount of $165,000.00 and recorded in the Clerk's Office of the Circuit Court of the Prince William county, Virginia on 11/10/2004, as Instrument No. 200411100191832, in Book ---, Page ---, the undersigned Substitute Trustees will sell at public auction on 02/21/2025 at 01:00 PM, Circuit Court for Prince Williams County, Front Steps, 9311 Lee Avenue, Manassas, VA 20110, the property designated as:
Beginning at a pipe on the north side of St. Rt. 234, which said pipe is west of the intersection of St. Rt. No. 677 and Rt. No. 234 approximately 900 feet, of which 300 feet is the frontage on Rt. No. 234 of a lot now or formerly owned by J. Gilbert Berry, and the remainder being 600 feet frontage on Rt. 234 of a lot sold to Noftsinger measures as follows: On the arc of a curve having a chord of S. 88 deg. 30-1/2` W. 236.95 feet to a concrete monument thence S. 81 deg. 27` W. 262.84 feet to a concrete monument; thence N. 89 deg. 18` W. 100.21 feet to a pipe, the said point of beginning, thence from the said point of beginning and following the curve having a chord of N. 89 deg. 18` W. 84.86 feet to a concrete monument; thence still following the northern edge of said Rt. No. 234, on the arc of a curve having a chord of N. 71 deg 09` W. 286.81 feet to point on the northern edge of Rt. No. 234 and with the land of now or formerly J. Gilbert Berry, N. 27 deg. 28.5` E. 635.8 feet (passing over a pipe at 480.07 feet) to a point in the middle of Bull Run; thence following the middle of Bull Run N. 68 deg. 51.5` 117.51 feet S. 50 deg. 15.5` E. 103.76 feet to a point; thence leaving Bull Run and following the western boundary of the island sold to Noftsinger S. 12 deg. 40` W. 658.36 feet (passing over a pipe at 42.6 feet) to the point of beginning on the northern edge of Rt. No. 234, and containing 4.286 acres, more or less in Prince William County, Virginia.
TERMS: CASH. A deposit of $16,500.00 or 10% of the sale price, whichever is lower, will be required of the successful bidder at time of sale. Prior to the sale, interested bidders will be required to register with and must present a bid deposit which may be held during the sale by the trustee. The bid deposit must be certified funds and/or cash, but no more than $9,900.00 of cash will be accepted. The successful bidder's deposit will be retained at the sale and applied to the sale price. If held by the trustee, all other bid deposits will be returned to the unsuccessful bidders. Settlement is to be made within 15 days. The successful bidder will be responsible for obtaining possession of the property, and for all costs and fees related to recording the Trustee's Deed, including the grantors tax. The successful bidder will be required to execute a Memorandum of Trustee's Sale, available for review upon request before the sale, outlining additional terms of sale and settlement. A Trustee's Deed will be prepared by Trustee's attorney at high bidder's expense.
