In execution of the Deed of Trust dated June 30, 2014 and recorded on July 1, 2014 in Instrument # 201400009909 and modified by loan modification recorded on October 12, 2021, of Spotsylvania County land records, Trustee Services of Virginia, LLC, the appointed Substitute Trustee, will offer for sale at public auction at the front of the building housing the Spotsylvania County Circuit Court, Judicial Center, Circuit Court entrance, 9107 Judicial Center Lane, Spotsylvania, Virginia on January 15, 2025 at 01:00 PM the property more particularly described in the aforementioned Deed of Trust, located at the property address listed below and briefly identified as follows:

All that certain lot or parcel of land, situate, lying and being in Courtland District, Spotsylvania County, Virginia, containing 2.500 acres, more or less, being conveyed in gross and not by the acre, and being all the rest and residue of Parcel "C", originally containing 5.00 acres, as shown on Plat of Survey of John C. Russell, C.S., dated June 27, 1964, and recorded in the Clerk's Office of the Circuit Court of Spotsylvania County, Virginia, in Deed Book 213, page 266, 2.500 acres of said Parcel "C" designated as Parcel C-1, which Parcel C-1 is shown on plat of Henry W. Cropp, Jr ., dated March 31, 1977, recorded in the next hereinafter mentioned deed dated April 8, 1977, from Winifred Nivens, et vir, and recorded in the aforesaid Clerk's Office in Deed Book 414, page 58, said parcel C-1 being retained and reserved unto Raymond A. Robinson and Shirley A. Robinson, and the remainder of Parcel C, less and except Parcel C-1, being the subject property.

This conveyance is subject to a non-exclusive easement and right-of-way for ingress, egress, to and from State Route 208, and related utilities, for the benefit of Parcel "B-1" and Parcel "B-2", 20 feet in width, as follows: Beginning at a point in the southwesternmost corner of the parcel herein conveyed, corner to Parcel "C-1" and Parcel "B- 1", thence along the southernmost boundary line of the parcel herein conveyed (which is contiguous with the northernmost boundary line of Parcel "C-1") to Parcel "D", said Parcel "C-1" being shown on plat of survey recorded in the aforesaid Clerk's Office in Deed Book 414, Page 62; Parcel "B-1" being shown on plat of survey recorded in the aforesaid Clerk's Office in Deed Book 414, page 61; Parcel "D" being shown on plat of survey recorded in the aforesaid Clerk's Office in Deed Book 213, page 266.

The Grantors further grant and convey unto the Grantees a non-exclusive easement and right-of­ way for ingress, egress, to and from State Route 208 to the property herein conveyed, and related utilities, 20 feet in width, in common with Parcel "B-1" and Parcel "B-2" (Parcel "B-2" being shown on plat of survey recorded in the aforesaid Clerk's Office in Deed Book 414, page 60) as follows: Beginning at the terminus of the easement and right-of-way reserved hereinabove, and continuing with the same course as said easement and right-of-way hereinabove described to a point in the northeasternmost boundary line of Parcel "D", thence along the northeasternmost boundary line of Parcel "D" in a southeast direction to its intersection with State Route 208.

The property will be sold "AS IS," WITHOUT REPRESENTATION OR WARRANTY OF ANY KIND AND SUBJECT TO conditions, covenants, restrictions, reservations, easements, rights of way, and all other matters of record taking priority over the Deed of Trust, if any.

Pursuant to Code of Virginia § 55.1-321(A2), if the property is being sold subject to another priority security instrument(s), purchaser must certify that purchaser shall pay off any priority security instrument(s) no later than 90 days from the date the trustee’s deed conveying the property being sold is recorded in the land records.

TERMS OF SALE: A non-refundable bidder's deposit of $24,500.00 or 10% of the sale price, whichever is less, by cashier's or certified check required at time of sale, except for the party secured by the Deed of Trust. Risk of loss is on the purchaser from date and time of auction. Balance of the purchase price must be paid by cashier's check within 14 days from sale date. Except for Virginia Grantor tax, all settlement costs and expenses are purchaser's responsibility. Taxes are pro-rated to the date of sale. Purchaser is responsible for obtaining possession of the property. If purchaser defaults, deposit may be forfeited and property resold at the risk and cost of the defaulting purchaser who shall be liable for any deficiency in the purchase price and all costs, expenses, and attorney’s fees of both sales. If Trustee does not convey title for any reason, purchaser's sole remedy is return of deposit without interest. This sale is subject to post-sale audit of the status of the loan secured by the Deed of Trust including but not limited to determining whether prior to sale a forbearance, repayment, or other agreement was entered into, the loan was reinstated or paid off, or whether the property became subject to an automatic stay under the U.S. Bankruptcy Code prior to the sale; in any such event this sale shall be null and void and purchaser’s sole remedy shall be return of deposit without interest.
