PUBLIC NOTICE NOTICE OF VOLUNTARY REMEDIATION Pursuant to the Virginia Voluntary Remediation Regulations, Virginia Administrative Code section 9VAC20-160-120, CESC WATER PARK, LLC and SMITH PROPERTY HOLDINGS WATER PARK TOWERS, L.L.C., 4747 Bethesda Avenue, Bethesda, MD 20814 hereby provides notice of voluntary remediation at the following site: Crystal City Water Park 1601-1701 Crystal Drive VRP Number VRP VRP01076 The Crystal City Waterpark site was bisected by a stream channel as early as 1885 until it was filled in and developed with a rail yard by 1936. The rail lines remained in use on the Site until the 1980s when the railroad tracks were moved to the east (outside the Site property boundaries) to allow for development of the east side of Crystal Drive. While excavating the site for a redevelopment project, petroleum contaminants and arsenic were detected in subsurface soils at levels which may pose risk to human health or the environment. To address potential environmental risks, CESC WATER PARK, LLC and SMITH PROPERTY HOLDINGS WATER PARK TOWERS, L.L.C. applied to and was deemed eligible to participate in the Voluntary Remediation Program. A Remedial Action Plan (RAP) has been reviewed and accepted as complete by the Virginia Department of Environmental Quality (DEQ). The RAP includes the excavation and off-site disposal of 12,600 tons of impacted soil and the installation of impervious cover. A ground water use restriction will be implemented to ensure that groundwater will not be utilized at the site.
